VA Disability Lawyer for Florida Veterans

Federally Accredited — Serving Florida Veterans Statewide from Sarasota

Florida is home to more than 1.5 million veterans, one of the largest veteran populations in the United States. From naval installations along the Panhandle to the active-duty communities around MacDill Air Force Base in Tampa, Eglin Air Force Base in Fort Walton Beach, and Naval Air Station Jacksonville, Florida has shaped the service of generations of American veterans. When those veterans come home carrying the physical and mental costs of that service, they deserve a benefits system that works. Too often, it does not.

Veterans Affairs Law, P.A. is based in Sarasota and serves Florida veterans statewide, as well as veterans across all 50 states through our federal VA accreditation. VA claims and appeals are governed by federal law, not state bar licensure, which means our team brings the same authority to cases in Jacksonville, Miami, or Pensacola that we bring to cases at home in the Tampa Bay area. Whether you are filing a new claim, fighting a denial, or trying to get a rating that reflects what your service actually cost you, we are ready to help.

We are your local Florida veterans law firm, and we represent Florida veterans everywhere in the state, from Key West to Pensacola, with the same commitment we bring to our Tampa Bay neighbors.

Why Florida Veterans Face VA Claim Denials

Florida's large and geographically diverse veteran population files an enormous volume of VA disability claims each year, and denials are common. Veterans connected to MacDill Air Force Base, Eglin, NAS Jacksonville, and NAS Pensacola face the same systemic problems as veterans everywhere: rushed C&P exams, nexus opinions never requested, records missed, and duty to assist obligations left unfulfilled.

The result is Florida veterans, from the Tampa Bay area to Miami, Orlando to Tallahassee, receiving denials or ratings that do not come close to reflecting the reality of their service-connected conditions. The most common denial reasons we see include lack of service connection nexus, inadequate C&P exam findings, insufficient medical evidence, and procedural errors. Every one of these is correctable with the right evidence and the right appeal strategy.

Florida State Veteran Benefits

Florida administers a range of state-level veteran benefits through the Florida Department of Veterans' Affairs (FDVA). These programs are separate from federal VA compensation, but many are tied to your VA disability rating, which means a wrongly denied or underrated claim can affect your eligibility at the state level as well.

Property Tax Exemption

Florida veterans with a service-connected disability rated at 10% or higher are entitled to a $5,000 reduction in their home's assessed value for property tax purposes. Veterans rated at 100% service-connected disabled, or who are totally and permanently disabled, receive a full homestead exemption, eliminating property taxes on their primary residence. Surviving spouses of qualifying veterans may also be eligible. Confirm current figures with your county property appraiser, as thresholds are subject to adjustment.

Important: If your VA disability rating was wrongly denied or assigned below what your conditions actually warrant, you may be missing a higher exemption tier. A rating increase can directly affect what you qualify for.

Education Benefits

Florida veterans and eligible dependents can access the federal Post-9/11 GI Bill along with the Florida Waiver for Survivors and Dependents, a tuition and fee waiver at Florida public colleges and universities for dependents of veterans who died or were totally and permanently disabled as a result of service. The Scholarships for Children and Spouses of Deceased or Disabled Veterans (CSDDV) program provides additional educational support through the Florida Department of Education.

Employment Assistance

The Florida Department of Veterans' Affairs provides veteran employment services including job placement assistance, resume support, and occupational licensing support for veterans whose military training qualifies them for state-regulated professions. Florida state government positions carry veteran hiring preference, and several programs specifically support veterans with service-connected disabilities re-entering the workforce.

Additional Florida Veteran Programs

The FDVA operates veterans' homes providing skilled nursing and domiciliary care across the state. Florida also provides free hunting and fishing licenses for veterans with a service-connected disability rated at 100%, reduced fees for other disabled veterans, and a veterans license plate program. The FDVA's Benefits Assistance program helps veterans access both state and federal benefits through regional offices statewide.

How Veterans Affairs Law Helps Florida Veterans

We represent Florida veterans at every stage of the VA disability claims and appeals process. Every step is handled remotely; no travel required.

  • VA disability claims — new filings and rating increases: Whether you are filing for the first time or pursuing a rating increase for conditions that have worsened, we build the strongest possible evidentiary record.
  • Denied VA benefits appeals: If the VA denied your Florida claim for any reason- lack of nexus, insufficient evidence, inadequate C&P exam, duty to assist failure- we identify the specific error and pursue the right appeal lane to correct it.
  • Secondary service connection: Many veterans are significantly underrated because secondary conditions caused by service-connected disabilities have never been claimed. We identify every condition you are owed.
  • Total Disability based on Individual Unemployability (TDIU): If your service-connected conditions prevent substantially gainful employment, you may be entitled to compensation at the 100% rate even if your combined rating is lower.
  • Survivor benefits (DIC) and accrued benefits: Surviving spouses and dependents of Florida veterans may be entitled to Dependency and Indemnity Compensation or accrued benefits the veteran earned but never received.
  • Board of Veterans' Appeals and federal court: When prior appeals have failed, we take cases to the Board of Veterans' Appeals and, when necessary, to the Court of Appeals for Veterans Claims.

Our fee is contingency-based; you pay nothing upfront and nothing out of pocket. If we win your case, our fee comes from a portion of your retroactive back pay, capped by federal law. If we do not win, you owe nothing.

Frequently Asked Questions

Can a Florida-based veterans lawyer represent me in Florida?
Yes. VA disability claims and appeals are governed by federal law, not state bar licensure. Our federal accreditation allows us to represent veterans in Florida and all 50 states. Your case can be handled entirely remotely — by phone, email, and secure document upload — without you needing to travel or appear in person.
Are Florida state veteran benefits the same as federal VA benefits?
No. Federal VA benefits — including disability compensation, VA healthcare, and the GI Bill — are separate from the state-level benefits Florida administers. However, many state benefits are directly tied to your federal VA disability rating, so a wrongly denied or underrated claim can reduce your eligibility for state programs as well. Pursuing the correct federal rating often has downstream benefits at the state level.
My Florida VA claim was already denied. Is it too late to appeal?
In most cases, no — but timing matters. If you received a rating decision within the last year, you are likely within the window to appeal without losing your original effective date, which determines how far back your back pay runs. The most important step is getting a professional review before more time passes. We offer free case evaluations with no obligation.
How much do your veterans legal services cost for Florida veterans?
Nothing upfront. Veterans Affairs Law works on a contingency fee basis — no retainer, no hourly fees, no out-of-pocket costs. Our fee is a percentage of the retroactive back pay we recover for you, capped by federal law at 20% for most cases. If we do not win, you owe us nothing.
